LANDLORDS AND COMMERCIAL LEASES

As an owner or manager of commercial real estate, we will help you maximize and protect your investment while meeting the needs of your tenant(s). From drafting leases and related documents, to assignment and subordination of leases, to collecting rent, to managing evictions when necessary, we can help make sure every step you take fits with your overall business goals.

Highlights of our work on behalf of landlords include:

  • Prepared and negotiated numerous retail leases for a commercial landlord who owned  a large retail center in Metro West.
  • Reviewed and negotiated a commercial landlord’s long-term lease extension with the Starbucks Corporation.
  • Negotiated a long-term lease with a national car rental company for garage space to be developed as part of a permitted and approved project in Boston.
  • Negotiated a complex lease termination agreement with a national billboard company, which involved the negotiation and settlement of a substantial claim against the tenant for damages caused to the landlord’s building.
  • Filed suit against the principal/guarantor of a defaulting art gallery tenant and collected substantial rent arrearages and attorney’s fees.

TENANTS AND COMMERCIAL LEASES

As a tenant with a commercial lease, you are entitled to certain rights. You want your business to have the space that is most conducive to its success. We can work with you to provide guidance on lease agreements, choice of location, using a lease as collateral for your financing needs, or defending against threats of eviction. Our lawyers will take the time listen to your goals, learn about your business and help you determine the solution that best fits your needs.

Highlights of our work on behalf of tenants include:

  • Represented a tenant in its ground lease negotiation in anticipation of its development of a retail strip center in Metro West.
  • Successfully overturned a summary judgment motion and damages in the amount of $865,000 against a client sued for fraud and deceit in regards to a lease he executed with Copley Place Associates.
  • Won a $300,000 settlement on behalf of a commercial tenant sued by their landlord. When the landlord sued the tenant for vacating the property prior to termination of the lease, the firm counterclaimed based on the illegality of that lease, leading to a quick and favorable settlement.
  • Negotiated a complicated lease termination agreement with a national landlord on behalf of a local restaurant tenant who was forced to close its restaurant.
  • Reviewed and negotiated a long-term funeral home lease on behalf of the tenant for space to be constructed in a mixed-use building in Everett, MA.
  • Represented numerous tenants in connection with lease modification agreements, in order, in part, to secure substantial rent arrearages and resolve various claims against the landlords.
