George Barclay and Alvin Nathanson secured a significant appellate victory for a Rudolph Friedmann client in its ongoing breach of contract dispute. The Massachusetts Appeals Court affirmed the trial court’s ruling awarding attorneys’ fees and costs to our client following its successful breach of contract claim.

The dispute stemmed from a jury verdict finding defendant liable for breach of contract, resulting in a favorable judgment for our client. After subsequent litigation, including an appeal, the matter returned to the trial court, which in December 2023 awarded attorneys’ fees for work performed between April 2021 and June 2023, consistent with the terms of the parties’ contract.

On appeal, the Appeals Court confirmed that the trial court’s decision was well within its discretion, rejecting defendant’s claims that the fees were awarded unfairly. The court also emphasized that our client’s request was both timely and aligned with the terms of the contract. Additionally, the Appeals Court upheld the trial court’s denial of defendant’s request to recover his own attorney’s fees, further bolstering our client’s legal standing and emphasizing the fairness of the ruling.
